Nvidia Cuda Toolkit License Agreement

No license, express or implied, is granted under nVIDIA patent rights, copyright or other NVIDIA intellectual property rights, in accordance with this document. The information published by NVIDIA regarding third-party products or services does not constitute a NVIDIA license for the use of such products or services, nor is there a guarantee or approval of those products. The use of such information may require a third-party license under third-party patents or other intellectual property rights or a NVIDIA license under NVIDIA`s patents or other intellectual property rights. NVIDIA products are sold in accordance with the standard NVIDIA terms delivered at the time of confirmation of the order, unless a single sales contract signed by authorized NVIDIA representatives and submitted to the customer has otherwise agreed (“Terms of Sale”). NVIDIA expressly opposes the application of the customer`s terms and conditions of sale with respect to the purchase of the NVIDIA product referred to in this document. This document does not create direct or indirect contractual obligations. Subject to the terms of this Agreement, NVIDIA hereafter grants you a non-exclusive and non-transferable license without the right to sublicensing (except expressly provided for in this Agreement) to: Subject to the other conditions of this Agreement, you may use the SDK to develop and test applications published in open source software licenses approved by the Open Source Initiative (OSI). You recognize and consent that it is your sole responsibility to obtain additional third-party licenses to manufacture, use, sell, import and sell your products or services, including microsoft, Thomson, Fraunhofer IIS, Sisvel S.p.A., MPEG-LA, and coding technologies. NVIDIA does not grant you patents or other necessary rights regarding audio and/or video encoders and set-top boxes under this Agreement. The following CUDA Toolkit files can be distributed with license applications that you develop, including some variations of those files that have integrated the version number or the architecture of specific information into file names – as an example only for version 9.0 of Windows 64-bit software, the cudart64_90.dll file is distributable.

6.4 By terminating this Agreement, you agree to immediately cease the use of the SDK and destroy all copies in your possession or control. Your previous distributions pursuant to this agreement are not affected by the termination of this agreement. On written request, you certify in writing that you have fulfilled your obligations in this section. If this agreement is terminated, all provisions are maintained, with the exception of the licences granted to you. 2.5 You should not use the SDK in a way that would make it subject to an open source software license. For example, the licenses required for the use, modification and/or distribution of the SDK (i) are disclosed or distributed as source code; (ii) a licence to produce derivative works; or (iii) for free. The Software Licensing Agreement in Chapter 1 and the Chapter 2 supplement contain licensing conditions governing the use of NVIDIA software.
